Terms of Service
These Terms of Service govern the relationship between you (the Client) and The New Home Marketing Group-Sales And Marketing, LLC regarding the provision of home sales support, marketing services, lead generation, and related consulting.
1. Scope of Services
The New Home Marketing Group-Sales And Marketing, LLC agrees to deliver the services described in your signed proposal or service agreement. Services may include new home sales strategy, digital marketing, community promotion, creative development, and campaign management. The New Home Marketing Group-Sales And Marketing, LLC may use approved third-party tools, vendors, or contractors to fulfill these services.
2. Fees and Advertising Spend
Client agrees to pay management and service fees according to the billing schedule in the service agreement, typically on a monthly basis unless otherwise stated. Service fees cover strategy, labor, and account management by The New Home Marketing Group-Sales And Marketing, LLC. Advertising and media spend paid directly to platforms (search, social, listing sites, etc.) is separate and is the Client's responsibility unless explicitly included in writing.
3. Client Responsibilities
Timely results depend on Client cooperation. Client will provide accurate community and inventory information, timely approvals for creative and offers, and required access to websites, ad accounts, CRM tools, and sales systems. Delays in approvals, access, or feedback may delay launches and reporting. The New Home Marketing Group-Sales And Marketing, LLC is not liable for missed timelines caused by Client delays.
4. Term and Termination
Initial engagements may require a minimum commitment period as stated in the contract (for example, 3 to 6 months). After that period, services may continue month to month unless otherwise agreed. Either party may terminate with written notice as specified in the agreement (commonly 30 days). Upon termination, The New Home Marketing Group-Sales And Marketing, LLC will transfer account access and deliverables as agreed, provided all invoices are paid.
5. Limitation of Liability
To the fullest extent permitted by law, The New Home Marketing Group-Sales And Marketing, LLC shall not be liable for indirect, consequential, or punitive damages arising from the services, including lost profits or business interruption. Total liability for any claim relating to the services shall not exceed the service fees paid to The New Home Marketing Group-Sales And Marketing, LLC during the sixty days before the event giving rise to the claim.
